These Terms and Conditions (“Terms”) govern your access to and use of Skylights.co.nz, a platform operated by Light for Life Limited (“we,” “our,” “us”). By using our platform, you agree to these Terms. If you do not agree, you must not use our services.

1. User Registration

Users may be required to register to access certain features of our website.
Users must provide accurate and up-to-date information.
Users are responsible for maintaining the confidentiality of login credentials and all activities under their account.
Skylights.co.nz reserves the right to suspend or terminate accounts for misuse or false information.

2. Installer Accounts & Enquiry Engagement

Installers must register and be approved before accessing customer enquiries.
If no enquiries exist in a selected region, the account will remain in pending status until enquiries are available.
To remain active, installers must engage with at least one enquiry within five (5) days of availability. Failure to do so may result in account suspension.
No refunds or compensation will be provided for installer inactivity.
Skylights.co.nz reserves the right to update or enforce engagement policies at its discretion.

3. Use of Website & Prohibited Activities

Users are granted a limited, revocable licence to use the website for personal or business purposes.
Prohibited activities include: data scraping, fraudulent activity, hacking, misrepresentation, or unauthorised use of platform content.
Breach of these Terms may result in suspension or legal action.

4. Intellectual Property

All content on Skylights.co.nz (logos, graphics, text, software, images) is owned by Light for Life Limited and its licensors.
Users may not reproduce, modify, or distribute content without written consent.

5. Privacy & Data Handling

Skylights.co.nz complies with the New Zealand Privacy Act 2020.
By submitting an enquiry, users consent to their details being shared with registered installers.
Customer information is not sold or shared with unrelated third parties.
Installers must comply with applicable privacy laws when handling user data.

6. Installer Responsibilities

6.1 Independent Contractor Status

Installers are independent contractors, not employees, partners, or agents of Light for Life Limited trading as Skylights.co.nz, unless engaged under a managed installation service as outlined in section 6.7.
Installers operate under their own business name and are solely responsible for their staff and subcontractors.

6.2 Insurance Requirements

Installers must maintain valid Public Liability Insurance and any other legally required insurance.
Proof of insurance must be provided on request. Accounts may be suspended if insurance lapses.

6.3 Compliance Obligations

Installers must:
- Hold all necessary trade licences and certifications.
- Comply with the NZ Building Code and health and safety laws.
- Obtain any required consents, permits, or approvals.

6.4 Advice Disclaimer

Skylights.co.nz does not provide technical, design, or structural advice regarding skylight placement or installation.
All installation recommendations are solely the responsibility of installers and licensed professionals, except where Light for Life Limited undertakes a managed installation contract under section 6.7.

6.5 Customer Data & Confidentiality

Installers may use customer data only for responding to enquiries and providing agreed services.
Sharing, selling, or misuse of customer data is prohibited.

6.6 Service Standards

Installers must provide accurate qualifications and deliver services with skill and care.
Installers must not misrepresent their relationship with Skylights.co.nz.

6.7 Liability Acknowledgement

Referral Services: Where Skylights.co.nz operates solely as an enquiry and referral platform, Light for Life Limited accepts no liability for the performance, workmanship, or conduct of independent installers. In such cases, installers are solely responsible for their services and indemnify Light for Life Limited against any claims, damages, or losses arising from their work or omissions.
In-House or Managed Install Services: Where Light for Life Limited contracts directly with a customer to manage an installation, supply products, or collect payment, Light for Life Limited accepts responsibility as the contracting party. In these cases:
- Light for Life Limited remains responsible for products it supplies, subject to applicable consumer laws.
- Installation work may be carried out by subcontracted independent installers. While all reasonable care is taken to engage qualified installers, Light for Life Limited’s liability for workmanship is limited to the extent permitted by law.
- Customers retain full rights under the Consumer Guarantees Act 1993 and other applicable laws.

7. Third-Party Links & Disclaimers

Skylights.co.nz may contain links to third-party sites. We are not responsible for their content or practices.
All information on our website is provided on an “as is” basis with no warranties.

8. Limitation of Liability & Indemnity

Light for Life Limited (trading as Skylights.co.nz) is not liable for:
- Services provided by independent installers where acting solely as a referral platform.
- Direct or indirect damages arising from use of our platform.
Users agree to indemnify Light for Life Limited against any claims related to misuse of the platform or breaches of these Terms.

9. Modifications & Termination

Skylights.co.nz may update these Terms at any time. Significant changes will be notified with at least 30 days’ notice.
Continued use of the platform constitutes acceptance of revised Terms.
Skylights.co.nz may suspend or terminate accounts for breaches of these Terms.

10. Governing Law

These Terms are governed by New Zealand law.
Disputes shall first attempt mediation before litigation.
Any unresolved disputes are subject to the exclusive jurisdiction of the New Zealand courts.
